How can you Legally Protect your Artificial Intelligence?
Our partners Julien Lacheré and Ilya Kalnish discussed with WIPR’s Sarah Speight about the challenges software companies have in keeping their new algorithms secret.
Copyright, trade secret protection, and “explainability” are the topics our patent agents cover in this article.
“More transparency on artificial intelligence (“AI”) patentability would definitely help the community better map out the line between what is eligible and what is not. I believe it would provide more certainty for all stakeholders, but I’m not so sure that the top priority for AI is to increase the level of protection. I think AI brings a lot more questions and challenges, such as explainability and regulation of AI use - for example, in the automobile industry with self-driving vehicles,” explains Julien Lacheré.
“AI is a field that is growing very quickly [and yet] many laws, especially patent laws, were put in place long before we could envision computers doing what they do today. The "buckets" for legal protection are very well defined. What we need is more clarity and to adapt these frameworks to the realities of AI today,” says Ilya Kalnish.
