The Federal Court of Appeal Rules in Favour of Soucy International Inc. and Kimpex Inc. in Patents Infringement Litigation

On October 28, 2020, the Federal Court of Appeal unanimously maintained, from the bench, the Federal Court decision which had previously dismissed a patents infringement action brought by Camso Inc.

The decision concerned three patents held by Camso Inc. relating to track systems used on "All-Terrain" Vehicles to facilitate their operation. The Court of Appeal ruled in favour of Soucy International Inc. and Kimpex Inc., represented by BCF. It dismissed the appeal and invalidated the 246 patents claims of Camso Inc. by way of anticipation and obviousness.
