Frédéric Côté is part of the litigation group. He advises and represents various clients in connection with commercial disputes and public law issues before the trial and appellate courts as well as arbitration tribunals.

Mr. Côté acts for clients in commercial litigation matters and in disputes involving governments, municipalities and regional authorities. In that capacity, he represents various construction and real estate interests, including in expropriation matters. He has specific expertise in major technical cases requiring the administration of complex expert evidence.

Mr. Côté has also developed particular expertise in consensual arbitration matters, both domestic and international, and in the filing of the associated proceedings before the Quebec courts and the Supreme Court of Canada. He has also acted as secretary on arbitration panels.

Representative work

  • Counsel for real estate developers in disguised expropriation proceedings before the Superior Court of Quebec and in expropriation proceedings before the Tribunal Administratif du Québec. The claim was in excess of $100 M and resulted from a land expropriation by a municipality on the north shore of Montreal.

  • Counsel for real estate developers in disguised expropriation proceedings resulting from the municipal and regional regulations adopted by cities and MRC/agglomerations on Montreal’s south shore. The claim was in the tens of millions of dollars.

  • Counsel for a real estate developer in a dispute that led to the granting of an injunction order enjoining the modification of a major road infrastructure so as to restore the natural land drainage and also involving the protection afforded to unlawfully flooded lands under the Environment Quality Act.

  • Counsel for a foreign company in proceedings for the recognition and enforcement of an arbitration decision by the ICC awarding the company over $100 M.

  • Counsel for the Council for the Arbitration of Accounts of Advocates of the Barreau du Québec in matters concerning the type of remedies that should be exercised to contest the arbitration awards rendered in the arbitration of accounts of professionals (Superior Court of Quebec and Court of Appeal of Quebec).

  • Counsel for the Société d’investissements l’Excellence Inc. in a matter concerning the existence of an implied duty of confidentiality in consensual arbitrations (Superior Court of Quebec, Court of Appeal of Quebec, Supreme Court of Canada).

  • Co-counsel for the Barreau du Québec, the Federation of Law Societies of Canada and ADR Chambers in interventions before the Supreme Court of Canada.

  • Member of the legal team having represented Louis Dreyfus S.A.S. in major ICC arbitrations concerning interests in a European refinery and in proceedings concerning the annulment of the awards having resulted from these arbitrations (ICC arbitration tribunals, Superior Court of Quebec, Court of Appeal of Quebec).

  • Mr. Côté also worked in-house at Transat A.T.’s legal affairs department temporarily for a period of one year in the context of a loan of his services.


Mr. Côté is also the BCF representative for ProBono Québec. In that capacity, he oversees and acts in cases on behalf of individuals who have called on the services of the organization.
