Court of Appeal Rules in Favour of Ville de Mont-Saint-Hilaire’s Real Estate Developers
The Court of Appeal of Québec has recently sided with property owners and real estate developers who sought to invalidate bylaws issued by the City of Mont-Saint-Hilaire to prevent real estate development.
Since 2013, the City of Mont-Saint-Hilaire (the “City”) has been trying to prevent a group of property owners and real estate developers (the “Developers”) from expanding into a mountainside area of the City. When discussions failed, the developers filed legal proceedings before the Superior Court of Québec which overturned the municipal bylaws.
Following an appeal by the City, the Court of Appeal of Québec recently ruled in the Developers’ favour and found the City in clear breach of its duty of good faith in the file’s management.
