A member of our Litigation group, Yannick Pomerleau practices in civil, commercial and construction litigation. Over the years, he has developed a particular proficiency in municipal litigation, administrative law and environmental law.
Yannick acts on behalf of a number of real estate developers in complex cases, particularly with respect to disguised expropriations and permanent injunctions. He advises our clients from the real estate and construction sectors in their permits acquisition and their nullity claims defence against municipal and/or regional regulations.
With a sharp and strategic mind, Yannick works to prevent potential conflicts and anticipate pitfalls. When litigation before the courts is inevitable, his great reliability ensures that he is in control of each case he handles.
Winner of the Prix sur la justice participative du Barreau du Québec, Yannick completed his bachelor's degree at the Université de Sherbooke, Co-op Program.

Representative Work
- Acted on behalf of a real estate developer in a dispute that led to an injunction to modify a major road infrastructure to restore the natural drainage of land, as well as the protection afforded to illegally flooded land by the Environment Quality Act;
- Acted on behalf of a construction firm in an action for damages in judicial review relating to the suspension of a major real estate project involving, among other things, the Minister of Municipal Affairs and Housing's refusal to recognize the conformity of the regional by-law with governmental policies;
- Acted on behalf of a real estate developer in a dispute over regional and local by-laws that had the effect of depriving the clients of any reasonable use of their land;
- Acted on behalf of landowners in the context of an action in nullity of a by-law adopted by a municipality on the South Shore of Montréal in order to gain recognition of the applicable rights to their land and, subsequently, in a case of disguised expropriation before the Court of Appeal of Québec;
- Acted on behalf of a real estate developer in a claim against the Ministère des Transports du Québec before the Superior Court of Québec in connection with the construction of a highway which resulted in the flooding of the client's property;
- Acted on behalf of a real estate developer in a litigation that led to an application for a permanent injunction against a municipality on the North Shore of Montreal to restore the normal flow of water and compensate for damages caused by the flooding of the client's property located in what appeared to be a wetland area;
- Acted on behalf of real estate developers in the context of a disguised expropriation case before the Superior Court of Québec following the expropriation of lands by a municipality on the South Shore of Montréal;
- Assisted real estate promoters in the execution of the agreements with municipalities, as well as permits and certificates needed for the implementation of large-scale real estate developments with a municipality on the North Shore of Montréal;
- Acted on behalf of a real estate developer in a litigation against the ministère de l’Environnement et de la Lutte contre les changements climatiques regarding a flood zone;
- Acted on behalf of a real estate developer in a contestation of a municipality's decision regarding a demolition permit;
- Acted on behalf of a client in the energy sector in the contestation of an access to information request to obtain confidential trade secret information;
- Acting on behalf of a crown corporation in a $33,4M construction dispute by a general contractor for various claim posts including different geological conditions, additional requests, unforeseen works and additional equipment maintenance.
