A member of the Commercial Litigation Group, Geneviève Bernier Gosselin practises mainly in Environmental, Administrative, and Municipal Law.

Geneviève acts on behalf of numerous general contractors and real estate developers in complex cases involving disguised expropriation and nullity of municipal by-laws. Analytical and meticulous, Geneviève knows how to anticipate pitfalls and never loses sight of the overall litigation strategy. Her legal research skills and rigorous management of court files make her an undeniable asset to our clients in the construction industry.

She completed her Bachelor of Civil Law summa cum laude. Throughout her academic career, she made the faculty Dean’s Honour List every year.

  • Acted on behalf of property owners in proceedings for nullity of by-laws adopted by a municipality on the South Shore of Montréal to obtain recognition of the applicable law concerning their land, and in the alternative, for disguised expropriation before the Québec Court of Appeal;
  • Acted on behalf of Développements St-Antoine in an expropriation dispute before the Tribunal administratif du Québec against the Ministère des Transports du Québec;
  • Acted on behalf of a real estate developer in a claim against the Ministère des Transports du Québec before the Québec Superior Court in connection with the construction of a highway resulting in the submergence of the client's property and the discriminatory application of municipal by-laws;
  • Acted on behalf of a construction company in an action for judicial review and damages relating to the blocking of a major real estate project involving, among other things, the refusal of the Ministère des Affaires municipales et de l'Habitation to recognize the conformity of the regional by-law with government guidelines; 
  • Acted on behalf of real estate developers in an appeal before the Québec Superior Court challenging the jurisdiction of the Tribunal administratif du Québec;
  • Acted on behalf of a group of Québec companies operating in the recycling industry in litigation against the Directeur des poursuites criminelles et pénales du Québec before the Cour du Québec concerning the contestation of penal infractions issued for non-compliance with environmental obligations; 
  • Acted on behalf of a general contractor in the construction industry before the Court in connection with contractual claims relating to a public contract awarded by call for tenders;
  • Acted on behalf of a transportation company before the Court in a challenge.
