Privacy and Data Protection Class Actions: Trends, Challenges and Best Practices
Two long awaited privacy and data protection bills are currently being passed: Federal Bill C-11 and Quebec's Bill 64. These amendments, in addition to Lamoureux v. OCRCVM, a decision dismissing a privacy class action on the merits, will certainly have an impact on class actions in Québec. Businesses should prepare for these changes as soon as possible.
Last October, we welcomed a guest of honour for a webinar on privacy and data protection class actions: the Honourable Nicole Duval Hesler, former Chief justice of Québec.
Along with Litigation Partner Shaun E. Finn and Danielle Miller Olofsson, Director - Access to Information and Privacy at Hydro-Québec, they discussed the trends, challenges, and best practices regarding the substantive and procedural issues raised by this type of recourse.
