Negotiation of collective agreements

A collective agreement affects your business for several years and has a major impact on your organization’s success. The experience of our labour law team will ensure that you are well advised in order to avoid difficult negotiations that can result in serious constraints or provoke avoidable confrontations. We participate in the negotiation of collective agreements on behalf of large, medium and small organizations in the private, public and parapublic sectors.

Labour Law

A large part of our business involves assisting our clients apply their collective agreements and arbitrate any ensuing grievances. Our expertise covers a broad range of situations, including dismissals, disciplinary action and interpretation. Our team regularly supports businesses that are subject to union raiding or motions for certification, whether those activities are governed by the Quebec Labour Code or the Canada Labour Code. We are also able to help our clients resolve any issues, which may arise during mergers, acquisitions or business restructurings.

Employment Law

Our professionals are regularly sought to advise clients about matters such as labour standards, employment terminations and layoffs, human rights and complaints of harassment or discrimination. We can help you develop business policies and rules as well as assist on enforcing non-solicitation, nondisclosure and non-competition obligations binding your former employees. We also draft individual employment contracts on a regular basis. Lastly, we also represent you every step of the way before the various courts, if the situation requires.

Occupational health and safety

Careful management of health and safety is vital for successfully managing your organization. BCF can advise, support and provide you with training to ensure that costs associated with workplace accidents are reduced as much as possible. We can guide you during investigations, the management of medical issues involved in a file, temporary assignments and when an employee’s return to work is contentious. BCF can also effectively defend your interests before the Commission de la santé et de la sécurité au travail, the Commission des lésions professionnelles or regarding the judicial review of decisions issued by these bodies.

Pension plans and benefits are an important part of the employer/ employee relationship. Due to our extensive experience in this field, we can help you obtain the most benefits from them. We will advise you with each step of the management of a pension plan and benefits, from their implementation through to their termination.
