Alternative Dispute
Resolution

Overview

Resolving disputes strategically. That’s what we mean by a different kind of practice.

Our Team

At BCF, we are constantly looking for solutions. Our Alternative Dispute Resolution team will help you in your business activities, by assisting in preventing or efficiently settling any litigious situations that may arise.

Our team has extensive experience in representing business and governments before arbitral tribunals and courts in domestic and international conflicts. We also regularly act as arbitrator and mediator in a variety of disputes.

Admitted to practice law in Quebec, Ontario, Alberta, New York, England and Wales, our team members also have extensive knowledge in such fields as new technology, energy, insolvency and restructuring, construction, telecommunications, biotechnology and international business.

Domestic Arbitration

Domestic arbitration is a dispute resolution mechanism with its own advantages and drawbacks. In certain circumstances, it can prove to be the most effective way to resolve disputes. Our team knows how to take advantage of the particularities of this type of dispute resolution and help you achieve results that are best suited for your business. We also have extensive experience representing clients before courts in arbitrationrelated matters, such as obtaining interim or provisional measures during arbitrations or homologating and annulling arbitral awards.

International Arbitration

International arbitration is the dispute resolution mechanism best suited to resolving commercial disputes arising between parties located in different countries. Contrary to foreign court proceedings, international arbitration offers a predictable and internationally accepted mechanism for the recognition and enforcement of foreign arbitral awards.

Our team has the expertise to strategically advise you on drafting arbitration clauses, to represent you during arbitral proceedings and to help recognize and enforce or annul arbitral awards.

We are also active both as counsel and arbitrator in the context of ad hoc and institutional arbitrations conducted under the rules of the ICC International Court of Arbitration, the LCIA, the ICDR and other major arbitration institutions.

Mediation

Not all disputes need be adversarial. Our team can analyze a contentious situation and identify the possible paths that may lead to resolution. Mediation involves resorting to a neutral and competent third party who may assist in bringing the parties to a mutually satisfying settlement. We have the necessary expertise to support you throughout this process so as to maximize results while protecting your rights.

Private International Law

Our team has significant experience in multi-jurisdictional disputes. We are often called upon to advise on matters involving questions of international jurisdiction, conflicts of laws and locally assisting foreign proceedings. We have developed a network of qualified contacts who can assist us in resolving problems arising in other jurisdictions where you may do business.
