A partner with the firm, Claude Paquet is a member of our banking law, financial services and restructuring group as well as of our Litigation group. He has many years of litigation and business experience and his varied clientele includes multinationals and small and medium-sized businesses, but especially financial institutions, receivers and business undergoing restructuring.
Mr. Paquet's primary fields of practice are commercial litigation, liquidation, bank litigation, restructuring and proceedings in bankruptcy and insolvency matters. He also has specific expertise in matters involving fraud and has developed an in-depth knowledge of agricultural issues.
The volume of cases he has managed and pleaded has brought Mr. Paquet before all levels of Quebec courts and has afforded him the opportunity to represent his clients in various types of procedures.
The cases Mr. Paquet has managed run the gamut, from the most traditional situations to precedent-setting cases. Over the years:
he has been lead counsel in major restructuring files, representing financial institutions having issued interim loans under the Bankruptcy and Insolvency Act and the Companies’ Creditors Arrangement Act (DIP lender). He has managed all types of cases related to short and long-term loans to businesses in distress or undergoing restructurings across all sectors as well as in various high-tech financial sectors;
he has been called upon to manage an impressive number of files for financial institutions involving various agricultural, mining, manufacturing and retail businesses. He has also acted as lead counsel in asset-based lending files as well as on behalf of a governmental entity with financings of several hundred million dollars in the energy sector;
he has carried out large seizures before judgment in movable and immovable matters after exposure of fraudulent networks and prepared the matters for criminal prosecution;
he has filed claims as a result of kiting operations;
he has assisted in the restructuring of a large number of distressed businesses, particularly in agricultural matters, at the request of the companies themselves or financial institutions, together with public agencies involved in such restructurings.
A gifted practical strategist, Mr. Paquet is consulted daily by various financial institutions on a multitude of subjects. Therefore, whether it is on:
issues related to businesses in crisis or being restructured,
issues related to bills of exchange, money laundering or other banking practices matters,
strategies related to potential litigation or asset-backed lending,
Mr. Paquet listens closely to clients and offers practical solutions while taking into account costs and benefits.
Finally, Mr. Paquet has been called upon to give conferences on his practice areas. He makes a special effort to give private conferences to his clients and to specialized groups among them many times during the year.
